Welcome to NegotiaScope. These Terms and Conditions (“Terms”) govern your access to and use of the NegotiaScope website, services, communications, consultations, and related materials (collectively, the “Services”). By accessing our website, submitting a request, purchasing a service, or otherwise engaging NegotiaScope, you agree to these Terms.
If you do not agree to these Terms, do not use our Services.
1. About NegotiaScope
NegotiaScope is a homeowner advocacy and project-support service. We help homeowners better understand proposed home projects, evaluate available options, identify questions to ask, review estimates and scopes of work, research and vet potential service providers, and negotiate project terms when appropriate.
NegotiaScope is not a construction contractor, handyman company, general contractor, subcontractor, engineering firm, architectural firm, inspection company, law firm, insurance company, or licensed trade contractor. NegotiaScope does not perform construction work, enter into construction contracts on behalf of customers, pull permits, supervise job sites, control contractors, or guarantee the work of any third party.
2. Our Role and Your Final Decision
NegotiaScope provides information, advocacy support, research, estimate review, and negotiation assistance to help customers make more informed decisions.
You remain solely responsible for:
- Selecting, hiring, contracting with, and paying any handyman, contractor, or other service provider;
- Reviewing and signing all contractor agreements, change orders, warranties, permits, and related documents;
- Confirming that any provider holds the required license, insurance, bonding, permits, and qualifications for the work;
- Making the final decision regarding your project, budget, schedule, materials, and selected provider.
Any recommendation, opinion, analysis, comparison, or information provided by NegotiaScope is for general guidance only and should not be treated as a guarantee of performance, price, savings, licensing status, project outcome, or suitability of a provider.
3. No Contractor Relationship; No Kickbacks
NegotiaScope works to support the homeowner’s interests. We do not perform the contracted work and are not responsible for the acts, omissions, pricing, scheduling, workmanship, materials, warranties, safety practices, employees, subcontractors, or business practices of any third-party provider.
Unless clearly disclosed to you in writing, NegotiaScope does not accept contractor referral fees, commissions, kickbacks, or compensation based on your decision to hire a particular provider.
A contractor, handyman, or service provider identified, discussed, researched, or contacted through NegotiaScope is an independent third party and is not an employee, agent, partner, joint venturer, or representative of NegotiaScope.
4. Service Fees and Payment
The applicable service fee, including any taxes or optional add-ons, will be disclosed before payment is requested. Fees are charged for NegotiaScope’s time, research, consultation, advocacy, estimate review, project-support, and related services—not for construction work.
Unless otherwise stated in writing, all fees are due at the time of purchase or before Services begin.
Refund Policy: Fees are nonrefundable once NegotiaScope has begun providing the requested Services, including consultation, research, provider outreach, estimate review, or negotiation support, except where a refund is required by applicable law or specifically approved by NegotiaScope in writing.
NegotiaScope may decline, pause, or discontinue Services if payment is not received, if the requested work is outside our scope, or if continuing the engagement would be unsafe, unlawful, or inappropriate.
5. No Guarantee of Savings, Price, or Results
NegotiaScope may help customers identify unclear scope items, compare pricing, ask better questions, negotiate terms, and avoid unnecessary costs. However, project pricing, savings, availability, contractor willingness to negotiate, project timelines, and outcomes vary by location, project type, market conditions, materials, labor availability, property conditions, and other factors.
NegotiaScope does not guarantee:
- That a customer will save a specific amount of money;
- That a contractor will lower pricing or accept a proposed scope;
- That any provider will be available, licensed, insured, qualified, responsive, or suitable;
- That an estimate is complete, accurate, or free of omissions;
- That a project will be completed on time, within budget, or to a particular standard;
- That a customer will receive a specific number of bids, quotes, or provider options.
6. Customer Information and Cooperation
You agree to provide complete, accurate, and current information about your project, property, budget, requested services, estimates, communications, and known conditions.
NegotiaScope may rely on the information you provide. We are not responsible for issues arising from inaccurate, incomplete, delayed, or withheld information.
You authorize NegotiaScope to communicate with potential service providers on your behalf for purposes of requesting information, discussing project details, comparing estimates, and supporting your decision-making process. You may revoke this authorization at any time by providing written notice; however, work already completed may remain subject to the applicable service fee.
7. Licensing, Permits, Safety, and Professional Advice
Customers are responsible for ensuring that all work is performed by properly licensed and insured providers when required by law. Customers are also responsible for confirming permit requirements, homeowner-association requirements, building-code requirements, inspections, zoning, and all other legal or regulatory obligations related to their project.
NegotiaScope does not provide legal, tax, engineering, architectural, insurance, financial, medical, or other licensed professional advice. You should consult a qualified professional when your project requires specialized advice or services.
8. Third-Party Websites, Providers, and Content
Our website or Services may reference third-party websites, businesses, reviews, products, providers, or services. Those third parties are independent from NegotiaScope. We do not control and are not responsible for their content, availability, accuracy, privacy practices, pricing, conduct, or services.
Any agreement between you and a third-party provider is solely between you and that provider.
9. Website Use and Intellectual Property
All content on the NegotiaScope website, including text, graphics, logos, designs, checklists, guides, photographs, videos, trademarks, and other materials, is owned by or licensed to NegotiaScope and is protected by applicable intellectual-property laws.
You may use our website and materials for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, sell, publish, reverse engineer, or exploit any NegotiaScope content without prior written permission.
10. Privacy and Electronic Communications
Your use of our website and Services is also subject to our Privacy Policy. By submitting your contact information, you agree that NegotiaScope may contact you by phone, text message, email, or other reasonable means regarding your inquiry, project, services, appointments, and related information.
Message and data rates may apply. Consent to receive marketing communications is not required to purchase Services. You may opt out of marketing text messages by replying STOP or using the unsubscribe method provided in the communication.
11. Disclaimer of Warranties
To the fullest extent permitted by law, the website and Services are provided on an “as is” and “as available” basis. NegotiaScope makes no express or implied warranty regarding the website, Services, third-party providers, project outcomes, estimates, pricing, savings, availability, or suitability for a particular purpose.
12. Limitation of Liability
To the fullest extent permitted by applicable law, NegotiaScope, its owners, employees, representatives, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the website or Services.
NegotiaScope will not be liable for damages, losses, injuries, property damage, delays, defective work, contract disputes, payment disputes, permit issues, code violations, warranty issues, or other claims arising from the acts or omissions of a third-party provider.
To the fullest extent permitted by law, NegotiaScope’s total liability for any claim related to the Services will not exceed the amount actually paid by you to NegotiaScope for the specific Service giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless NegotiaScope and its owners, employees, representatives, and affiliates from claims, damages, liabilities, costs, and expenses arising from your project, your use of the Services, your violation of these Terms, or your agreement with any third-party provider.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
Before filing a legal claim, you agree to contact NegotiaScope and make a good-faith effort to resolve the matter informally. Any legal action arising from these Terms or the Services must be brought in a state or federal court located in Clark County, Nevada, unless applicable law requires otherwise.
15. Changes to These Terms
NegotiaScope may update these Terms from time to time. The updated version will be posted on this website with a revised Effective Date. Your continued use of the website or Services after an update constitutes acceptance of the revised Terms.
